ASCNDED Terms of Service

These terms govern your use of ascnded.com and the ASCNDED facial analysis service, operated by Asynchronous OÜ, Estonia ("ASCNDED", "we", "us"). By using the service you agree to these terms. Contact: ascndedofficial@gmail.com.

1. What ASCNDED is

ASCNDED analyzes photos of your face and produces a report: measurements of facial proportions compared against published aesthetic conventions and male reference ranges, plus AI-generated observations and non-surgical suggestions (grooming, styling, skincare categories, lifestyle, and topics you may choose to discuss with professionals).

The report is informational only. It is an aesthetic measurement tool, not an assessment of your worth, and its reference ranges are conventions, not scientific or medical standards.

2. Not medical advice

Nothing in the service is medical, dermatological, psychological, dietary, or other professional advice, and no doctor–patient relationship is created.

• Where the report mentions findings such as skin or hairline observations, these are automated visual impressions, not diagnoses.
• Where the report names treatments, medications, or procedures, these are examples of options that exist for a topic, provided for education, so you can have an informed conversation with a licensed professional. Only a qualified clinician who has examined you can determine whether any option is appropriate or safe for you.
• Never start, stop, or change any medication or treatment based on the report.
• Weight-related suggestions are general fitness information; consult a professional before significant dietary changes.

If you experience distress related to your appearance, consider speaking with a mental health professional. The service is not designed for, and must not be used as, support for body dysmorphic concerns or eating disorders.

3. Eligibility

You must be at least 18 years old. You confirm this when starting a scan. The service is currently designed for male facial reference ranges.

4. Your photos and content

• Only upload photos of yourself. Uploading photos of any other person, including minors, is prohibited and grounds for immediate termination.
• You retain ownership of your photos. You grant us a limited, revocable license to process and store them solely to provide the service to you, as described in the Privacy Policy.
• Your report is for your personal use. You may share it privately; you may not resell it or present it as professional advice.

5. Purchases, delivery, and refunds

• The analysis report is a one-time digital purchase. Prices are shown at checkout and may include VAT or sales tax depending on your location. Payment is processed by Stripe.
• The full report is delivered immediately after payment.
• EU/EEA/UK consumers: because this is digital content delivered immediately, you will be asked at checkout to expressly consent to immediate delivery and acknowledge that you thereby lose your 14-day right of withdrawal. This is a condition of purchase.
• Beyond rights that mandatory consumer law grants you, all sales are final and we do not offer refunds. If the service fails to deliver your report due to a technical fault on our side, contact us and we will regenerate it or refund the purchase.
• Initiating a chargeback for a delivered report instead of contacting us may result in account termination.

6. Acceptable use

You agree not to:

• upload photos of third parties, minors, or images you lack rights to;
• probe, scrape, reverse-engineer, or bulk-query the service, or use it to build a competing dataset or product;
• misrepresent report contents as coming from a medical professional;
• attempt to bypass payment or access controls.

7. Accuracy and availability

Analysis quality depends on photo quality, lighting, angle, and other factors outside our control. Measurements are estimates produced by automated systems and carry stated confidence levels; results can vary between photos. We do not guarantee any particular measurement outcome, nor any real-world outcome (including dating, social, or career results) from following the report. We may modify, suspend, or discontinue features at any time; your purchased report remains accessible per the retention terms in the Privacy Policy.

8. Intellectual property

The service, including its software, measurement methodology, report design, and content, belongs to Asynchronous OÜ or its licensors. You receive a personal, non-transferable license to access your report. Feedback you send us may be used to improve the service without obligation to you.

9. Disclaimer and limitation of liability

To the maximum extent permitted by law:

• the service is provided "as is" without warranties of any kind;
• we are not liable for indirect, incidental, or consequential damages, or for decisions you make based on the report;
• our total liability for any claim is limited to the amount you paid for the service in the 12 months before the claim.

Nothing in these terms excludes liability that cannot be excluded by law, including mandatory consumer protections in your country of residence, or liability for intentional misconduct or gross negligence.

10. Termination

You may stop using the service and request account deletion at any time. We may suspend or terminate accounts that violate these terms; if we terminate without cause, purchased reports remain accessible or the purchase is refunded.

11. Governing law and disputes

These terms are governed by the laws of Estonia. If you are a consumer in the EU/EEA/UK, you also keep the protection of mandatory rules of your home country, and you may bring disputes before your local courts. EU consumers may also use the European Commission's Online Dispute Resolution platform (ec.europa.eu/consumers/odr). We prefer to resolve issues directly: email us first.

12. Changes

We may update these terms; material changes will be announced on the site with a new effective date. Continued use after changes means acceptance.
